CASH BAIL: AN ASSURANCE OF COURT APPEARANCE OR A PERPETUATION OF WHITE UPPER INCOME CLASS VALUES?

In the first half of our hour, we will replay Jamie Jackson’s December 2018 interview with Professor Peter Edelman, Carmack Waterhouse Professor Of Law And Public Policy at the Georgetown Law Center, then Cherise Fanne Burdee, Executive Director of the Pretrial Justice Institute, and finally, Michael John Voss, co-founder of the ArchCity Defenders in St Louis, MO.  Each will speak  about the myths and misconceptions used to support the bail bond system in our criminal courts and how this system, unique to the US and the Philippines, is bad policy.

In our second half hour, Jaws of Justice Radio will take a contemporary look at the Bail Bond industry, the arguments used to support it, the unfair effects on the poor, the negative effects on the economy and local communities. Host Terri Wilke will speak with Pedro Irigonegaray, an attorney and partner with the firm of Irigonegaray, Turney and Revenaugh, LLP, a Topeka law firm that provides criminal and personal injury legal services.  Their mission is to provide comprehensive legal services to families in Shawnee County Kansas.

Pedro Irigonegaray was recently featured in a Dole Institute of Politics presentation:  The Counselors, which featured two advocates arguing either side of an important national issue – bail bond reform. In a cross between a courtroom trial and a debate, the two counselors presented their opposing arguments and called two expert witnesses each to help build their case.

There has been some movement, particularly in other jurisdictions, to stop the cash bail system.  Martin Luther King, Jr., reminded us that “the arc of the moral universe is long, but it bends toward justice.” Change takes a long time, but it does and can happen,

particularly if we advocate for change.
